Reporting point for potentially illegal content on Nimbu

Zenjoy BV hosts websites and web applications of Nimbu Customers. Through this procedure, any person or organisation can report specific content that he or she considers illegal. This is the notice-and-action mechanism of Article 16 of Regulation (EU) 2022/2065 (Digital Services Act).
Submitting a notice
Send the notice electronically to abuse@zenjoy.be and state:
- a sufficiently substantiated explanation of why you consider the specific information to be illegal, stating the relevant legal basis where known;
- the exact URL or URLs and, where necessary, additional information enabling the content to be located precisely;
- your name and e-mail address, except where the notice concerns possible criminal offences as referred to in Articles 3 to 7 of Directive 2011/93/EU; and
- the statement: “I confirm in good faith that the information and allegations contained in this notice are accurate and complete to the best of my knowledge.”
Attach only evidence that is necessary to assess the notice and do not send sensitive personal data that is not necessary.
Handling
Zenjoy:
- confirms receipt without undue delay where contact details are available;
- handles sufficiently precise and substantiated notices in a timely, diligent, objective and non-arbitrary manner;
- assesses the specific content, context, severity and consequences and takes the fundamental rights involved into account;
- may request additional information where the illegality cannot be sufficiently assessed;
- informs the reporter without undue delay of the decision and the available means of redress; and
- informs the affected Nimbu Customer or User with a clear statement of reasons where content or access is restricted, unless this is prohibited by law or precluded by an urgent security reason.
Zenjoy does not use solely automated legal decision-making on the illegality of specific content. Automated security, spam and traffic filters may, however, carry out technical blocks.
Possible measures
Depending on the circumstances, Zenjoy may take no measure, request additional information, remove specific content or make it inaccessible, proportionately suspend a feature or account, or execute a binding order.
Where Zenjoy becomes aware of any information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of one or more persons has been committed, is being committed or is likely to be committed, it shall promptly inform the competent law enforcement or judicial authorities and provide all available relevant information, in accordance with Article 18 DSA.
Contesting a decision
The reporter, Customer or affected User may contest the decision, stating reasons, via abuse@zenjoy.be. State the original reference, the contested decision and the specific reasons. Zenjoy has the contestation assessed by a competent person who does not rely solely on automated means.
